California Privacy Notice

This California Privacy Notice supplements the Mood Privacy Policy and applies only to California residents. It is provided pursuant to the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act of 2020 (collectively, the “CCPA”), and the regulations of the California Privacy Protection Agency. Terms defined in the CCPA (such as “personal information,” “sell,” “share,” and “sensitive personal information”) have the same meanings here. This Notice describes our practices during the 12 months preceding the Last Updated date, and our current practices.
1. Categories of Personal Information We Collect, Sell, or Share
The table below lists the categories of personal information we have collected in the preceding 12 months, and whether we “sell” or “share” each category as those terms are defined by the CCPA. We do not sell personal information for money. However, some of our disclosures — the use of advertising cookies and pixels (cross-context behavioral advertising), and disclosure to our corporate affiliates for their marketing purposes — may constitute a “sale” or “sharing” under the CCPA. You may opt out at any time (Section 5).

Sources of personal information: you directly (account creation, orders, communications); automatically from your device (cookies, pixels, analytics); our service providers (payment, age verification, customer support, order management, fraud prevention); data enrichment and marketing providers; advertising and analytics partners; and social media platforms you use to interact with us.
Purposes: providing and improving our products and Services; processing orders and payments; age and identity verification (legal obligation); communicating with you; marketing and advertising, including on behalf of our corporate affiliates; security and fraud prevention; and legal compliance. We do not collect additional categories or use personal information for materially different purposes without notice.
Minors: our Website and products are restricted to individuals 21 years of age or older. We do not knowingly collect, sell, or share the personal information of any consumer under 16 years of age.
2. Sensitive Personal Information and Your Right to Limit
We collect two categories of sensitive personal information: (1) government identification information and images, used solely to verify that purchasers are at least 21 years old, as required by law, and deleted after verification; and (2) payment card information with access credentials, processed by our PCI-DSS compliant payment processor to complete your transactions and, where you opt in to save a payment method or maintain a subscription, stored by our payment processor in tokenized form. You may remove stored payment information at any time through your account settings or by contacting team@mood.com.
We use and disclose sensitive personal information only for the limited purposes permitted by CCPA regulation section 7027(m) — performing the services you request, verifying age as required by law, preventing fraud, and ensuring security — and we do not use sensitive personal information to infer characteristics about you. California residents nonetheless have the right to request that we limit the use and disclosure of sensitive personal information to those limited purposes. Because we already restrict our use in this way, no additional limitation is generally available, but you may submit a request using the methods in Section 6 and we will confirm our practices to you.
3. Retention
We retain each category of personal information only as long as reasonably necessary for the purposes disclosed above, determined by: the nature of the purpose (e.g., active account servicing vs. one-time verification); our legal obligations (e.g., tax and transaction records); the applicable statutes of limitations; and security and fraud-prevention needs. Identity-verification images are deleted after verification is complete. Marketing data is retained until you opt out.
4. Disclosure to Corporate Affiliates
As described in Section 6.5 of our Privacy Policy, we may disclose identifiers (name, email address) and commercial information (purchase history) to members of our corporate family for their own marketing purposes. Because certain affiliates operate under brands other than Mood, this disclosure may be treated as a “sale” or “sharing” under the CCPA. You may opt out at any time using any method in Section 5, and if you have opted out of Mood marketing communications, we will not disclose your contact information to affiliates for their marketing purposes.
5. Your Right to Opt Out of Sale or Sharing
California residents may opt out of the sale or sharing of personal information at any time, by any of these methods:
- Email: team@mood.com, subject line “Privacy Rights Request” (general) or “Affiliate Sharing Opt-Out” (for affiliate disclosures). We will process your verified request as an opt-out of the sale and sharing of your personal information.

- Advertising platform and browser controls: the platform-specific opt-out links and browser cookie settings described in Sections 4 and 9.2 of our Privacy Policy limit the advertising cookies and pixels through which sharing for cross-context behavioral advertising occurs.
Opting out stops the sale and sharing of your personal information, including for cross-context behavioral advertising. You may still see ads, but they will not be tailored using personal information we share. We wait at least 12 months before asking you to re-consent to sale or sharing after an opt-out.
6. Your Other California Privacy Rights
- Right to Know/Access: the categories and specific pieces of personal information we have collected about you, our sources, purposes, and the categories of recipients.
- Right to Delete: deletion of personal information we have collected from you, subject to statutory exceptions (e.g., completing transactions, security, legal compliance).
- Right to Correct: correction of inaccurate personal information.
- Right to Data Portability: a copy of your personal information in a portable, readily usable format.
- Right to Limit Sensitive Personal Information: as described in Section 2.
- Right to Non-Discrimination: we will not deny you goods or services, charge different prices, or provide a different level of quality because you exercised your privacy rights.

We will verify your identity using information associated with your account or order history; we may request additional information where necessary, and we will not use verification information for any other purpose. You may designate an authorized agent by providing the agent written permission and verifying your own identity with us. We respond to verified requests within 45 days, extendable once by 45 days with notice.
7. Notice of Financial Incentive
We offer the programs described below, each of which provides a discount or benefit in exchange for personal information. Because these programs provide a price difference in exchange for personal information, California law requires this notice. Participation in every program is voluntary, and you may withdraw at any time as described below. We will not discriminate against you for declining to participate or for exercising your privacy rights; if you withdraw, you may still purchase from us on the same terms as any other customer, though you may no longer receive program benefits going forward.
Email Signup Offer. New customers receive a one-time discount of 20% off their first purchase in exchange for joining our marketing email list. To participate, submit your email address through our signup form and consent to receive marketing emails. The personal information involved is identifiers (your email address). Withdraw at any time by clicking “unsubscribe” in any marketing email or emailing team@mood.com; withdrawal stops future marketing emails and does not retroactively affect a discount you have already redeemed.
Loyalty Program. Customers who join our loyalty program earn points on eligible purchases that can be redeemed for discounts on future orders. The personal information involved is identifiers (name, email address) and commercial information (your purchase history, which determines points earned). Withdraw at any time by contacting team@mood.com to close your loyalty account; unredeemed points may be forfeited upon withdrawal, and withdrawal does not affect rewards you have already redeemed.
Eligibility-Based Discounts. Where offered, eligible customers (such as military service members and veterans) may receive a discount after a one-time eligibility verification performed by our verification provider. The personal information involved is identification and eligibility-status information submitted to the verification provider; we receive confirmation of eligibility. Participation is one-time and voluntary; if you prefer not to verify, you may simply purchase without the discount.
Value of your personal information. For each program, we have made a good-faith estimate that the value of the personal information you provide is reasonably related to the value of the benefit you receive — that is, the value of the discount or rewards themselves. We calculated these estimates using the expense to Mood of providing each incentive, taking into account the discount or reward amounts, the costs of operating the programs, and the revenue we anticipate from communications with participants.
