1. SPONSOR
The Mood Instagram Giveaway (“Mood Giveaway”) is sponsored by Mood E-Commerce, LLC (“Sponsor”). The Mood Giveaway is in no way sponsored, administered, executed, or produced by any Meta or Instagram Entity, and by participating in this Mood Giveaway, each entrant completely releases Instagram/Meta from any and all liability related to this promotion.
2. ELIGIBILITY
The Mood Giveaway is open to legal residents of the United States (“Eligible Territory”) who are twenty-one (21) years of age or older at the time of entry (unless otherwise specified). Employees of Sponsor, Mood Giveaway prize suppliers, participating advertisers, and immediate family members of anyone so situated are not eligible. “Immediate family members” shall include spouses, siblings, parents, children, grandparents, and grandchildren, whether as “in-laws,” or by current or past marriage, remarriage, adoption, co-habitation or other familial extension, and any other persons residing at the same household location, whether or not related.
State-Level Exclusions: Due to strict state-level milligram limits and prohibitions on hemp-derived cannabinoids, residents of the following states are NOT eligible to enter or win: Alabama, Alaska, Arkansas, California, Colorado, Connecticut, Hawaii, Idaho, Iowa, Maryland, Montana, New York, North Dakota, Ohio, Oregon, Rhode Island, Utah and Vermont. Void outside the Eligible Territory and where prohibited or restricted by law, rule, or regulation.
3. GIVEAWAY PERIOD
Entries will be accepted from June 10th, 2026, at 11:30 AM Pacific Time (“PT”) until June 24th, 2026, at 11:29 AM PT (“Entry Period”). Any entry received after the close of the Entry Period will not be eligible.
4. HOW TO ENTER
Instagram Entry: To enter, you must follow @moodbevco (account must be public), like the official giveaway post, and comment your “mood” on the public Instagram feed.
Bonus Entries: Participants receive one (1) additional entry for each unique friend tagged in the comments, up to a maximum limit of three (3) extra entries total. Tagged accounts must belong to real individuals. Anyone found using multiple accounts to enter will be ineligible for the Giveaway.
Alternative Method of Entry (AMOE): Alternatively, participants can send an email to sydney.stanford@mood.com with their first and last name, email address, birthdate, and phone number by the close of the Entry Period. Email entrants may receive up to three (3) bonus entries (for a total of 4 entries) by requesting bonus entries in their email submission.
Limit of four (4) entries per person total, regardless of method of entry. Email entrants may request up to three (3) bonus entries in their initial email submission.
5. PRIZE, VALUE, & DELIVERY CONDITIONS
One (1) Grand Prize winner will be selected at random. The Grand Prize winner will receive a Mood beverage pack consisting of an assortment of Mood hemp-derived THC beverages and branded merchandise.
The Approximate Retail Value ("ARV") of the Grand Prize is $19.00.
The prizes are personal to the selected winners and not assignable or transferable to any other person or entity, and cannot be exchanged for money or anything of value. All federal, state, and local taxes, and any other costs and expenses associated with prize acceptance and use not specified herein as being provided are the sole responsibility of the winner.
Prizes consist of hemp-derived cannabinoids. These products have not been evaluated by the Food and Drug Administration (FDA). They are not intended to diagnose, treat, cure, or prevent any disease. Consume responsibly. Winners assume all liability regarding the consumption of the prize.
Delivery Requirements: All products are federally compliant under the 2018 Farm Bill (<0.3% Delta-9 THC). However, because the package contains 21+ regulated products, a valid government-issued photo ID and an adult signature (21+) will be strictly required at the time of delivery.
Sponsor reserves the right to substitute any prize (or portion thereof) with one of comparable or greater value, including cash or gift cards, at its sole discretion if the advertised prize becomes unavailable or cannot be lawfully delivered.
6. WINNER NOTIFICATION & CLAIM PROCESS
Sponsor will contact the winner using information submitted during entry by direct message on Instagram. Sponsor is not responsible for any changes to or discrepancies with participant contact information.
In any event where a winner does not respond to Sponsor within forty-eight (48) hours of receipt of the direct message communication, cannot be located after reasonable efforts by Sponsor, or fails to provide valid photo ID proving they are 21+, a new winner will be selected.
To obtain the name of the winner, mail your request along with a stamped, self-addressed envelope to: Mood E-Commerce, LLC, 1401 Freedom Dr., Charlotte, NC 28208. Requests must be received no later than 30 days after Mood Giveaway ends.
7. PUBLICITY LICENSE & DATA OWNERSHIP
You understand that you are providing your personal information to Sponsor. All Giveaway entries become the exclusive property of Sponsor and Sponsor may use any of the entries for any purpose whatsoever, without further compensation to the entrant. Where permitted by law, winners and participants grant to Sponsor the right to print, publish, broadcast and use, worldwide in any media now known or hereafter developed, including but not limited to the world wide web, at any time or times, the winners’ and participants' submissions, names, portraits, pictures, voices, likenesses, the identity of their city and state of residence and biographical information for advertising and promotional purposes without additional consideration.
8. RESTRICTIONS AND LIMITATIONS OF LIABILITY
Sponsor reserves the right to cancel, terminate or modify the Giveaway if it is not capable of completion as planned for any reason, including, but not limited to, infection by computer virus, bugs, tampering, unauthorized intervention or technical failures of any kind. All decisions of Sponsor are final.
Sponsor and each of their subsidiaries and affiliates, their officers, directors, agents, stockholders, insurers, and employees assume no responsibility or liability whatsoever for damages, loss or injury resulting from participating in any contest or sweepstakes, or acceptance or use of any prize.
In consideration of participation in the Giveaway, the entrant does hereby waive any and all claims against Sponsor and its Released Parties for any injury, damage, or loss that may occur, directly or indirectly, in whole or in part, from participation in the Giveaway or receipt or use of the prize (or any portion thereof).
Sponsor is not responsible for late, misdirected, lost, or misplaced entries for any reason, including electronic or computer malfunctions, nor are they liable for any injury or damage to entrant’s or any other person’s computer or hardware related to or resulting from participating in the Giveaway. Sponsor shall have no liability for any malfunction of the Internet, Sponsor's website, or Instagram.
9. WARRANTY DISCLAIMER
YOUR ACCESS TO AND PARTICIPATION IN THE GIVEAWAY IS AT YOUR OWN RISK. YOU UNDERSTAND AND AGREE THAT THE PRIZES DELIVERED TO YOU THROUGH THE GIVEAWAY ARE PROVIDED TO YOU ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY REPRESENTATIONS, WARRANTIES OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED. WITHOUT LIMITING THE FOREGOING, SPONSOR DISCLAIMS ANY WARRANTIES, EXPRESS OR IMPLIED, OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE AND NON-INFRINGEMENT.
10. ARBITRATION & CLASS ACTION WAIVER
As a condition of entering this Giveaway, each entrant agrees that (a) any and all disputes, claims, controversies, or causes of action arising out of or relating to this Giveaway or any prizes awarded shall be (i) arbitrated on an individual basis only and shall not be consolidated or joined with any other proceeding and (ii) settled by binding arbitration in Charlotte, North Carolina before a single arbitrator appointed by JAMS in accordance with its then governing rules and procedures; and (b) under no circumstance will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses.
11. GOVERNING LAW & DISQUALIFICATION
These Official Rules shall be governed by and construed and interpreted in accordance with the laws of the State of North Carolina. Sponsor reserves the right to disqualify any person for violating these terms, tampering with the entry process, or engaging in disruptive behavior. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY PROPERTY OR UNDERMINE THE LEGITIMATE OPERATION OF THIS GIVEAWAY MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW.
12. ADDITIONAL TERMS AND CONDITIONS
Sponsor reserves the right in its sole discretion to supplement or make changes to these Official Rules at any time without notice. Sponsor reserves the right in its sole discretion to interpret the Official Rules, and such interpretation shall be binding upon all participants. Sponsor shall not be responsible for any administrative errors involved in the execution of the Mood Giveaway.
